This privacy policy explains how Heather Pierce Musco (dba “HEATHERVOX”) collects, uses and discloses personal information that is collected from the HEATHERVOX website and when HEATHERVOX provides Services (for purpose of this policy, will be collectively referred to as "Services").

Through this Privacy Policy, HEATHERVOX provides information about the information collected, how its collected, the purposes for which it is used, and HEATHERVOX provides notice of how you can contact HEATHERVOX with any inquiries or complaints, the types of third parties to which HEATHERVOX discloses the information, and the ways, if any, HEATHERVOX offers for limiting how personal information that HEATHERVOX collects or receives is used and disclosed.

HEATHERVOX may change this Privacy Policy from time-to-time.  When changes are made, HEATHERVOX will notify you by revising the date at the top of the policy and, in some cases, may provide additional notice (such as adding a statement to the homepage or sending email notification). Please review this Privacy Policy from time to time so that you can stay informed about information collected and used by HEATHERVOX.

The Services are not targeted or directed at children under the age of 13 and HEATHERVOX does not knowingly collect or store any personal information from children under the age of 13.

COLLECTION OF INFORMATION

Information and Data About You
When you use and/or interact with the Services, you may provide personal information, such as your name, company name, email address, address, phone number, and corresponding passwords, as well as other information that you otherwise choose to provide or is required for purposes of you using the Services. You may, for example, send and/or receive text messages, other types of messages and/or voicemails, and when you do, HEATHERVOX will collect and use your telephone number and the content in any messages you send/receive. 
If you subscribe to Services in which you interact with HEATHERVOX, you may consent to provide other personal information, authorize recordings of your voice or participation in sessions and any such data and information is subject to this Privacy Policy.  Also, if you authorize HEATHERVOX to work with others you engage (i.e. other service providers), HEATHERVOX may receive personal information about from those service providers.

Other Data
Cookies are required to provide the HEATHERVOX website and may be required for other Services.  A cookie is a small amount of data, which often includes an anonymous unique identifier that is sent to your browser from a web site’s computers and stored on your computer’s hard drive. HEATHERVOX uses cookies to record session information.

HEATHERVOX uses analytics software to improve the functionality of the Services. This software allows us to collect and record data about how the website and online services are used, how often webpages are accessed, other usage data, and performance data, among other data. Standing alone, this information is not personal information and HEATHERVOX does not link it to any personal information.

HEATHERVOX uses personal information as follows: to provide, maintain, analyze and improve Services; Process transactions and send related information, including confirmations; to send notices, support and administrative messages; to send information about special events or offers and for other marketing, informational, product development and promotional purposes; to respond to emails, comments, questions and requests and provide customer service; to monitor and analyze trends, usage and activities in connection with the Services; to personalize and improve the Services and provide content or features; to undertake a request from you; and/or to carry out any other purpose for which the information is collected.

SHARING AND TRANSFER OF INFORMATION

HEATHERVOX does not sell, share, or rent any personal information to third parties in any ways different from what is disclosed in this Privacy Policy.  However, HEATHERVOX may share with third parties non-personal information, aggregated information or other anonymized data which cannot reasonably be used to identify you.

HEATHERVOX shares personal information that is collected as follows, and as otherwise described in this Privacy Policy:

·        Service providers. With vendors, consultants and other service providers who need access to such information to carry out work on behalf of HEATHERVOX and/or in order to provide the Services;

·        ‍When Required by Law and Certain Requests. In response to a request for information, if HEATHERVOX believes disclosure is in accordance with any applicable law, regulation or legal process, or as otherwise required by any applicable law, rule or regulation. Similarly, if HEATHERVOX believes it is reasonable to do so to protect the rights, property and safety of HEATHERVOX or others;

·        Business Transactions. In connection with, or during negotiations of, any merger, sale of assets, financing or acquisition of all or a portion of HEATHERVOX to another company, or in connection with an internal re-organization of HEATHERVOX;

·        Your Consent. With your consent or at your direction, including without limitation your agreeing to applicable terms of service, or if notice is provided through the Services.

SECURITY

HEATHERVOX takes reasonable, physical, technical and organizational measures to prevent unauthorized access, unlawful processing and unauthorized or accidental loss, destruction, or damage to your personal information.

DATA RETENTION

HEATHERVOX retains personal information (even after you stop using Services) for as long as necessary to comply with legal obligations, for her business purposes, including but not limited to resolving disputes, troubleshooting service problems, as required by law, and/or to enforce the terms of service, other applicable agreements and/or this Privacy Policy. HEATHREVOX may retain non-personally identifiable information without any specific term limitation.

YOUR CHOICES

Please note that HEATHERVOX reserves the right to send certain important communications relating to the Services, such as service announcements, security notices and Legal Notices, without offering the opportunity to opt-out of receiving them.

You may opt out of receiving communications from HEATHERVOX that are identified as promotional materials by following the instructions in those emails or by sending a request to heather at heathervox.com. If you opt out, HEATHERVOX may still send you non-promotional communications as indicated above.

Individuals in the EU and Switzerland have certain rights related to personal data collected and may, for example: request access to personal information collected, request corrections be made, withdraw their consent for processing it, and request deletion subject to certain limitations (e.g. requests for deleting personal data may not be accepted if HEATHREVOX is required to comply with a legal obligation or in relation to a legal claim).  Any such requests should be sent to heather at heathervox.com. Any withdrawal of a consent does not affect the lawfulness of processing based on consent before its withdrawal. HEATHERVOX does not sell personal information.  

DO NOT TRACK

Do Not Track (or DNT) is an optional browser setting that you may set in your browser to relay to website you visit your preferences regarding tracking across websites. HEATHERVOX does not have a mechanism in place to respond Do Not Track requests. For clarity, HEATHERVOX continues to collect information in the manner described in this Privacy Notice from web browsers that have enabled DNT signals or similar mechanisms.

YOUR CALIFORNIA PRIVACY RIGHTS

Under California Civil Code sections 1798.83, California residents may request a notice describing what categories of personal customer information HEATHERVOX shares with third parties or corporate affiliates for those third parties or corporate affiliates’ direct marketing purposes. To the extent applicable to HEATHERVOX, such notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses. If you are a California resident and would like a copy of this notice, please submit a written request with subject line “Privacy Policy” to the following address: heather at heathervox.com. Please specify that you are requesting the California Privacy Rights Notice and allow at least 30 days for a response.
